SMS Privacy Policy

SMS Finance (“SMS”) considers an individual’s right to keep their personal information private is of high importance. SMS is committed to ensuring that any personal and/or financial information that it obtains is accurate and that it protects and maintains the privacy of the individual.

National Privacy

SMS Finance is bound by the National Privacy Principles in regards to the collecting, handling and storage of personal information and has Privacy Policies and Procedures in place which comply with those Principles. Some of those principles are summarised in this Privacy Statement. Should detailed information concerning the National Privacy Principles be required, then contact should be made with the Federal Privacy Commissioner.

Information Collected via our Website  

  • In respect of personal information provided to SMS via this website, SMS will only record e-mail addresses or other personal details of a person if that person sends a message to SMS. That information will only be used for the purpose of contacting that person to respond to the request contained in the e-mail and SMS will not disclose that information to anyone without the person’s consent.
  • Please note that there are risks associated with the transmitting of information via the Internet and while SMS has security measures in place to ensure that personal information is kept secure and confidential, you may wish to contact SMS by (a) phone; or (b) visiting our office; or (c) facsimile; or (d) letter.

Collecting Information  

  • SMS will only collect information that is of relevance to the relationship it has with its clients. Some of the information SMS collects may be of a personal nature. SMS may also need to collect financial information and other information relating to a client’s business operations.
  • SMS endeavors to collect all information direct from its clients. When it is necessary to collect the information from other sources, SMS will advise the client in advance.
  • SMS will not source or collect sensitive information or opinions about clients unless it is necessary to provide a service to them. Sensitive information includes (but is not limited to) information on a person’s origin, political opinion, religious beliefs, sexual preferences or health details.
  • SMS will not source or retain Tax File Numbers of individuals. Any TFN’s that are received in error will be immediately destroyed.

Using Personal Information

SMS will only use any personal information it collects to:

  • Carry out its business activities including research, planning, account management, portfolio management and analysis;
  • Fulfill its legal obligations.
  • Market its products and services from time to time. If an individual does not want to receive such information, they can notify SMS and this practice will be discontinued.

Access to Personal Information

  • SMS will provide selected information to some other organisations to perform specific functions, but only with the client’s consent. These organisations are required to adopt the same high standards in regards to privacy issues.

Security

  • SMS has adopted procedures to ensure personal information is kept secure and confidential.
  • Employees can only access information that they require to perform their duties.
  • Employees are trained in Privacy Legislation requirements and how they relate to them. Management conduct regular inspections to ensure compliance by staff.
  • SMS endeavours to keep personal information complete and accurate.

Client Access

Clients’ can access most of the personal information SMS holds about them by contacting the office. In the majority of cases there will be no charge for providing the information that has been requested. Costs will only occur if the request requires a significant amount of time to prepare.

Human Error

As advised, SMS is committed to privacy and has implemented policies, procedures, processes and checks to ensure their goal is achieved. Despite this, on occasion mistakes do occur due to human error. If there is a belief that Privacy Legislation has been breached, or that SMS’s own standards are not being met, please contact SMS and the matter will be fully investigated. A response will be provided within one (1) week and all reasonable action will be taken to ensure that the problem does not re-occur.
